Pretrial Assessment Validation Report

Senate Bill 36 states that a pretrial risk assessment tool shall be validated using the most recent data collected by the pretrial services agency within its jurisdiction, or, if that data is unavailable, using the most recent data collected by a pretrial services agency in a similar jurisdiction within California.

Because many counties did not have sufficient data available to conduct a validation, the report released by the Judicial Council of California may be referenced. (Penal Code sections 1320.35(b)(4) and 1320.35(c)(2))

Transparency Requirements

Senate Bill 36 states that a pretrial services agency shall make the line items, scoring, and weighting as well as details on how each line item is scored, for the pretrial risk assessment used by the agency. (Penal Code section 1320.35(d))
